I don't understand why you are necroposting a 2009 thread..
The theme is broken as it more then likely was for 1.4 and currently MyBB runs 1.6.5, you'll need someone to make the edits to the theme to fix the problems or go look for a theme that's compatible with MyBB 1.6.x
