would this happen to be the query SELECT * FROM mybb_massemails

Forget whether if it's illegal or not, you'll lose most of your members if you do this.

Regardless, it's pretty easy to bypass, even if you do remove the option to change it.

I only send out emails weekly telling members whats new etc.

People nowadays don't like to receive emails from whatever website, unless they CHOOSE to do so.. You're pretty going to lose all your members by doing this, there must be an option for them to stop receiving your emails, otherwise they're going to mark your address as "Junk" and so your site will be blacklisted..
