I presume that is not legal,but if you have permission from invisionpower you can (MAYBE with big M) create non commercial / non redisturable version for PERSONAL USE only.

Believe me, I've made one, and tried to get permission and got a big no.

What a sursprice they told you a big NOT, I mean, who will their project´s theme being used in any other project, even if it was legal.

I can't understand the desire of people to have MyBB (because free) and impersonate it as a paid board like vBulletin or IPB... If you want vBulletin or IPB style, buy vBulletin or IPB!
