But by clicking the Agree button new members are agreeing to it, but if you want a tick box why don't you add a custom Profile Field in the Admin CP?
Admin CP>>Configuration>>(left hand side Custom Profile Fields)>>Add a new Profile Filed.
Set one up maybe called Agreed to registration agreement and select it as a tick box.
Will then have to tick it to agree as part of registration.

that's not quite what I'm looking for. on this
page member.php?action=register, I'd like there to be a check box next to the 'I agree' button somewhere.
