I don't think he's releasing the theme publicly, but then again there's a good chance that I'm wrong.

Even if you're using it for a private forum, you'll need permissions. It does resemble the theme, though if you are trying to get an exact match (with permission), it shouldn't take too long to do the edits -- at least for the index, since I'm unsure if you've done everything else. Looks good! (Although XenFocus has nice and quality themes, I still think they're really generic).
