I wonder how to fix this issue:

It is not theme related. I've tried many themes, which in most cases this problem exists aswell.

Does this problem only occur when you have sub-forums shown? If so, it is a problem with your theme (or so from the picture, all we can see). Try looking under your templates under the forum display area (may be an issue with the forumdisplay_subforum or just the first main display page placing it in an odd manner).
I've had this with many other free and premium themes. I think it has something to do with the fact that in the beginning, I wanted to have custom icons. I followed a guide I think and changed a bit there and there in the forum bit templates. I tried to edit / revert to original yesterday, it does solve the background image, but then the other layout things change.
