Yes, the menu/drop down menu uses the Superfish jQuery. Other jQuery is used for the modal login and the profile tabs.

No need to mention it. It's common sense to discuss these things in private. Asking stuff like this in public is needless. But, nevertheless, here is the screenshot of the email and I'll add it to the first post:

The theme itself, looks old. The design world has moved forward a lot lately, and the days of large gradients, shadows and clip art like text effects are gone, for now at least. I don't really know what you plan to do with this theme, if it is in order to work with an existing WordPress blog you have then fine, the goal then is to make the port look as similar to the original as possible.
If you plan to release, I think you need to make that more clear to the original owner, that email I would see as a confirmation for personal use only. Re-distribution to earn money or other gain on someone elses' work could be a different matter.
In regards to the theme itself, it is one of hundreds that look like it. I don't see any uniqueness or modern style of any sort. You may have plans for this, but at the moment, nothing attracts me with this theme.
