Happening to me in my custom theme as well.

It always gets attached to the next div but I haven't got about a solution get. Positioning was my first though.
It only happens for the first post so it may be related to some class or id missed since I use xThreads first post feature using different templates for the first and subsequent posts. Dunno.

Removing position: relative; from #content actually fixed the issue, but I believe the popup menu should be changed to decide the position differently.
