When I fill out a DOB on User-CP the next box is privacy which it is blank in the drop down so I cannot save the profile

How do I fix for Blackevo4 theme

Blackevo4 was made for 1.6.

You can revert the usercp_profile template.

But downloadfing and using a 1.8 compatible theme is more recommended. Otherwise you may and probably will find more issues in Blackevo4.
