Of course the latency part and the data protection is other thing that the person who hires the server must know or ask, but as I said, it's other topic.
And as I said, it's not a stretch to assume an Australian company is offering their services within Australia, unless otherwise specified. Which, again, failure to state it is not in Australia breaches s.18 of the Competition and Consumer Act.
You should not need to ask where a server is hosted, it should be stated.
