has very recently introduced a bill that could threaten the future of the
domain name industry and internet commerce. Snowe's bill has been
introduced as the "Anti-Phishing" bill, but contains provisions that are
largely unrelated to these objectives. These provisions radically and
unnecessarily expand the rights of trademark owners to essentially provide
them with monopoly rights on registered trademarks. This would be to
the detriment of millions of individuals and businesses engaged in
lawful and legitimate Internet commerce.


If the bill passed through congress, it may allow large businesses to
take domain names with little to no effort. Trademark owners already
prevail in 85% of all UDRP complaints and nearly 100% of all ACPA cases.
Yet some apparently now wish to establish a new regime for contesting
allegedly “infringing” domains that is tilted even more in their
favor by denying basic due process and substantive protections to domain
name registrants – and that provides the possibility that they can use
their power and influence to sway public officials to expend taxpayer
dollars in defense of private Intellectual Property Rights (IPRs).


The proposal unfairly targets domain name registrants for a widespread
Internet practice – if it's aim is to halt the advertising
monetization of brand names and typographical variations thereof when consumers
engage in direct Internet navigation or in web searches it utterly fails
in that endeavor, as this activity is also engaged in systematically
by search engines, web browsers and ISPs.


We need to do as much as possible to make sure the bill is revised to
serve it's purpose of preventing phishing scams and not to bury domain

If it helps prevent domain touting I'm all for it.
but some people register domains just for redirects as their site is not getting traffic

so i think its good and bad! so just trademark your forum its easy

Yeah, very easy. It only costs a couple of hundred dollars!
Don't forget about the people who park & sell domains for a living.
If they have 50 domains, try trademarking every single one.

How could that be passed it sounds like stealing with out getting in trouble.
I'm lucky for four reasons:
a) I live in Canada, this is a US law.
b) I registered my domain with a Canadian company.
c) My server is also hosted in Canada... By me.
d) The people who own the TM to Line Rider(what my site is about) don't have their actual HQ in Canada.

So, as a result, I am pretty much immune to this.

Ya for these reasons its going to be almost impossible to enforce outside the US. I don't understand why the government would make such a useless law that seems to have nothing to do with phishing. If you don't want phishing to happen they should make laws on how good protection has to be by companies and educate people Wink.
I don't really get it, but it sounds like it will stop those idiotic people who take domains that they know will be wanted and then hike up the fees so that legitimate business can't afford them.
It's probably a way to get there ""tax relief"" back. Let's just hope it doesn't pass. If it does, thousands of domains will be stolen, Identity theft will probably occur, all sorts of problems will arise. If companies want an "easy" way of getting domains, they should try purchasing them like everyone else does. Business doesn't come cheap. Coming up with great names may take months, and having some idiot come and steal it from you after months of work isn't a bright idea. I have 2 domains that are what we call "the pot of gold." If a company comes and takes them from me they won't see the end of me. Not now, not ever.
