The reason that might seem like that to you is that, we have to enforce these limitations and binding agreements to users. If we soften up, we might miss out on important details or tell it vaguely and people might exploit that. They aren't there to provoke you, but just a way for us to ensure that people are following these guidelines before downloading/using/modyfing their copy of MyBB.
MyBB isn't exactly open source either.
All companies/groups who develop/distribute/sell any kind of product, have to make sure that they cover every single gap, to avoid people exploiting any "loop holes". That is why it is always better to check with the people first, if you think you could be infringing their license/terms of use. Better to be safe than get a nice large law suit on your hands. Wink

Because say if MyBB was GPL, anyone could take the code, moddify it and call it their own.
Ok, so why would anyone bother with GPL if anyone can do that?
And why does it not bother the developers of phpbb for instance?

I'm not trying to say MyBB should be GPL; just trying to get a better understanding of open source/GPL and why it's favoured by some and not others
