You do not have to be a member to download, you have to be a member for support, I think it means each download must be made from mybb and no other external sources. im not sure.
If i remember right to download early versions of the software you had to provide a valid email address before being sent the link.

Yeah, that sounds right. I think redistribution is illegal, like it is with most other bulletin board software, even free ones.
