Who's the author, and how can you show proof that you have permission?

One of the authors of this theme is my uncle, and I have asked permission from him.

I think your need the MAIN developer's permission.
BTW, just changing the typing style can't convince any one..

The theme actually belongs to Frost from white-fusion.com Shadow, Ika sold all rights to all of there phpBB themes.
