Basically, cover your lime by putting in your TOS that you can read them - even if you never have to.

It's not illegal if you clearly state it and don't make any assurance that a private message is actually private.

Some countries its illegal either way.

How do I do that and how can I change my TOS?

You would need to go through the language files (either via Admin CP or /inc/languages/english) and change instances of Private to Personal. I don't know where you personally keep your TOS, so I don't know. A good idea is to make one using the Help section.

I see when signing up you agree to "Registration Agreement" is that my TOS?

You can edit it in: inc/languages/english/member.lang.php

So it looks like that is where All my language is for the entire forum, is that true?

So i have to carefully read through all of it in order to find what I want to change?

Like change the words Private to Personal?
Correct. You can find lots of it in global.lang.php Smile

And I went into private.lang and found many "Private" words and changed them to personal.

Do you think when I someday upgrade to 1.6 I will have to do it again or will it stay the same?

Also, is it possible to ad a banner or adsense to the footer?
