If we notice someone has removed a theme copyright in violation of the theme licence in a showcase thread then we will close it but there is little we can do beyond that.

As Matt said, its impossible for us to keep track of every theme and its difficult for us to fairly make a judgement against a 3rd party licence so unless they are violating our rules or our licence we won't deny them support.

We strongly suggest authors take their own actions to ensure their licences are complied with, a cease and desist is a good start.
One thing you could also do is release the themes only on your own community, so that you can easily ban people who infringe your license from downloading themes.
There is nothing MyBB can do about it. This is a sad fact of releasing themes. If it's too big of an issue for you, your only option is to stop releasing themes. You can also release them paid with no copyright.
Also edit the index.html in the theme image directory and add your copyright. This is normally ignored by those who grab themes. This makes it easy to DMCA the host and a link to the theme copyright on a page is clear evidence.

MyBB has been fair about taking action on members who flout copyright of it's contributors. Just report the post. You can't expect them to do a lot more than that.
Thanks for the suggestions, next time I create a theme I'll keep them in mind.
Its not mybb staff's problem if your being too dependent on the trust of the downloader, if you've licensed your product correctly the law is always on your side.
