If he is gonna use it on his own site, you cannot restrict him, it is his right.
Moreover in some cases, competition is free, to get better and stronger mods.

For willow, if you don't know, basically protocole made a vBulletin skin for myBB, containing all those AJAX function of vBulletin 3 in the skin and even the WSIblah Editor. However, some myBB users cannot wait for the release and keep on bother protocole for it and protocole decided to
stop continuing the skin and decided to keep the skin for itself and
not willing to distribute it. I know he did it, but I believe he also did it for myBB users and also myBB. If he were to release the skin, I can gurantee you that there will be lots of complements for protocole. But (sadly) from what I know, he is not distributing the skin.
