hmmm....i am closing this on the basis of
a.) A lot of people seem to reckon this theme was made by Scoutie
b.) Even if the theme did change hands to Audentio (which i do not know) sincerely doubt he would link the copyright to flickr's stuck in customs (the MyBB's header image and copyright)
