Newpoints Uploading Contents Error before I upgrade

Fatal error: Cannot redeclare newpoints_check_permissions

This is when I uploaded the contents of the upload folder.

I'm sure the fix is something simple, I just have no idea what it may be.

I am not touching the coding until someone tells me what to do.

I have a sad face right now
