If the patch doesn't work, maybe you need to ask your server manager to upgrade to PHP 5.3 or higher.

PHP 5.2 is outdated and is not supported anymore. So count that patch just as a favor! I don't have that version on my debug server so I couldn't test it but logically it would work though as I told before I wouldn't bother myself giving medicine to the dead. The real fix would be upgrading PHP to the latest stable version.
