And to whoever said copying is good because it's innovative (or whatever), there's a fine line between inspiration and copying. He has passed it.

No proof that the content in mentioned is copyrighted, no proof that my content is directly derived from his. Let me put this in perspective for you.
I am going to write a horror story, the main "monster" or "bad guy" will be a clown. Am I able to get a copyright claim filed against me just because Stephen King wrote the book "IT"? No. You cannot copyright an idea. Also, if you want to be technical the css code is all written by me and is automatically copyrighted to me because I am the sole author of it. (In part, minus MyBBs standard issue code.) In the end my hosting provider is legally made to remove the hold on my hosting account until the "original author" can prove their case and or file a lawsuit against me within 10 days.

Also, your scenario hurts you. You wrote a story about a clown, alright fine. So you can take his theme and use the inspiration and make a different (VERY DIFFERENT) dark theme, correct? No problem, if you did it well I'd probably commend you on it.
It's more than just borders, it's pretty much the entire theme minus a few color changes. I suggest you at least have respect for other people.
I have had nothing but respect for people. Anyways, I have a new theme in development. Should be done in a few days. If you would like to stop commenting about the theme situations and contact me via pm (as I have asked multiple times) then please do so. Your arguments seem to have the same tunnel vision responses. So, let me state this: please refrain from posting in my thread about the theme. He has filed a copyright claim so let it be. It is between me and theme junkies to sort this out. Although if you have something constructive to contribute to my thread I welcome you to do so.
After about 5 hours of work I have finished the new theme. Hopefully with this theme everyone can be happy and I can move forward with my site. Sorry for any inconveniences I may have brought up. Anyways, looking for criticism on my new theme!
