There are no open bugs with the latest version of the theme and the latest version of mybb.

a lot of images seem to be missing. they are in the code but not in the image files. I used firefoxes web developer tool and it keeps finding broken images

Can you give examples please.

Oh, sorry I forgot to come back and update this.
I had the wrong folder. some were looking in the root images and other images were in a images/mybulletin format.

tcat3_bg.png was shown as a broken image though but i think it was invisible to start with
