Well, I am guessing it uses PHP In Templates plugin - I do that on leefish as well, and it really makes it hard to share a theme with it in as it is not MYBB core. It is a shame as it makes MYBB superpowerful. It is the best plugin out there imo.

On the layouts - yes, like I said - I am avoiding looking too much as I don't want to be influenced by the design, though I do like where you are going with it, its a bit too modern for my site and so I would not use it. It would make a great theme though.

PHP in Templates is a little risky imho, when you have a dev team on your forums at least. Conditionals is great though, too bad that's not default. It would be cool if you could just post the code you have in certain templates in the Themes section, though, for other users of those plugins. Would definitely be cool here, as a lot of this stuff you're adding is awesome brad. xD

I would have no problem saying, "To use this theme you must have Template Conditionals." Any admin who is doing serious customization should have it, and it's free.

You probably need to add some margin-top in header's menu to fit it to the top.

Love this theme! Few things,

I feel the box in the top corner needs more of a gap after the text. Seems to cut off too soon? and also on the forum display there seems to be a huge blank area?

The placement is intentional.

Not sure what you're referring to. Can you post screenshots?
